Since 1 February 2023 family and domestic violence leave has become a paid entitlement for National System Employees under Div 7 Pt2-2 of the Fair Work Act 2009, by virtue of the Fair Work Amendment (Paid Family and Domestic Violence Leave) Act 2022.
An employee can take up to 10 days leave at their full rate of pay in a 12 month period (s 106A Fair Work Act 2009).
